REGULAR MEETING MINUTES

September 5, 2023

A REGULAR MEETING of the Stillwater Township Committee was called to order by Mayor L. Chammings at 6:03 p.m. Mayor L. Chammings stated that this meeting is being held in compliance with the provisions of P.L. 1975, Ch. 231, Secs. 4 & 13 the Sunshine Law and that adequate notice of the meeting has been published in the New Jersey Herald as to the time, place, and date of meetings, and is posted in the usual location of posted notices in the municipal building as well as electronically on the township website and Facebook page.

A MOTION was made by Committeewoman V. Rumsey, seconded by Committeewoman D. Delaney, with all members in favor, to adopt the Resolution permitting the Committee to go into Executive Session at 6:04 p.m.

RESOLUTION FOR EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Stillwater, in the County of Sussex and State of New Jersey as follows:

1. The public shall be excluded from that portion of this meeting.

2. The general nature of the subject matter to be discussed is as follows: Personnel, Litigation/Potential Litigation and Attorney Client

3. As nearly as can now be ascertained, the matter or matters to be discussed at this time will be disclosed to the public when such matters are resolved.

BILLS LIST #13 $1,758,764.85

Committeewoman V. Rumsey stated that she had a couple questions on the bills list before approval. She asked what the item was for “Swank Motion Pictures” and answered that it was a Recreation Commission item for their outdoor movie night.

Committeewoman V. Rumsey asked about the four different bills for vehicle maintenance for the DPW. She wanted to know if the bills were for parts that the DPW mechanic would be using to repair vehicles or are Campbell’s, Home Depot and Smith Tractor Equipment were doing the repairs? Township Clerk L. Knott looked up the receipts and noted that the bill from Home Depot was for glossy black paint, the bill from Tractor Supply was for parts, the bill from Campbell’s was for a belt tensioner and the Smith Tractor Equipment bill was for a fuel pump.

Committeewoman V. Rumsey asked about the $7,315 bill for the Spotted Lantern Fly was. Township Clerk L. Knott explained that it was paid for with the $15,000 grant that was received from the State of New Jersey. She stated that the township has contracted with Farmside to spray for them.

RESOLUTION 2023-162 AUTHORIZING PAYMENT OF BILLS

WHEREAS, the Chief Financial Officer has certified that funds are available in the proper account; and

WHEREAS, the Chief Financial Officer has approved payment upon certification from

the Township Department Heads that the goods and/or services have been rendered to the

Township;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Committee of the Township of Stillwater that the current bill lists, dated September 5, 2023, are on file and available for public inspection in the Office of the Chief Financial Officer and approved by the Chief Financial Officer for payment, be paid.

COMMITTEE REPORTS:

Committeewoman D. Delaney

Recreation Commission

Committeewoman D. Delaney stated that she did not have an update for Recreation as their meeting is scheduled for the next day.

Zoning Board of Adjustment

Committeewoman D. Delaney stated that the Zoning Board of Adjustment meeting was held on August 28th. All members were in favor for completeness on Block 1801 Lot 22. All members were in favor of approving a waiver for Block 1801 Lot 22 for the removal of a leaking underground oil tank located under the garage so that they may begin remediation right away.

The Zoning Board of Adjustment also requested that the Township Committee consider appointing Mr. William Doolittle to the Zoning Board of Adjustment as a member.

Mayor L. Chammings thanked Deputy Clerk V. Ingles for filling in for Zoning Board Secretary P. Bair at the meeting.

Committeeman P. Barta

Planning Board

Committeeman P. Barta stated that he was unable to attend the Planning Board meeting on August 16th, that Mayor L. Chammings sat in at the meeting in his absence. Mayor L. Chammings stated that the Planning Board had two resolutions that needed to be memorialized, which they approved. She stated that Planning Board member Dean Voris had some good ideas about things that he’d like to do that he would like to discuss with the Township Committee, Recreation Commission, and the Environmental Commission. He will put his ideas in writing so that all the Township Committee members may review the information and pass it along to the other appropriate committees for their review as well.

Committeewoman V. Rumsey

Emergency Services

Committeewoman V. Rumsey stated that the fire department requested to take the fire siren off the community center roof and restore it. She stated that the reason that it hasn’t been functional for years is due to the number of complaints that came in from township residents and the elementary school regarding the noise.

Mayor L. Chammings suggested referring to an old state statute that gave specific emergencies that the siren should be sounding off to alert the community, that it should not be going off for every call that comes in. She stated that a possibility would be to revert to what it used to be according to that state statute.

Committeewoman V. Rumsey stated that payment to Atlantic Communications will be needed to have them remove the antennas from the community center roof for the reroofing project and for them to reinstall them after the roofing has been completed.

Community Center

Committeewoman V. Rumsey stated that the new doors have been installed at the community center however she has received multiple complaints on them regarding the user codes and the door not being able to stay unlocked while groups are using them. She referred them to the clerk’s office for their user codes and for questions on how to operate the door correctly.

Municipal Clerk L. Knott stated that all the organizations have received their access codes and that they are in the process of having another key made so that the door will be able to be unlocked for use once they enter the building.

Committeewoman D. Delaney expressed concern for the key being removed from the building by mistake. L. Knott replied that they will have a wire attached to the key and have it screwed into the wall so that the key will not be able to be removed accidentally.

Committeewoman V. Rumsey stated that she is going to ask the DPW to put a second handicap parking space at the community center with access on the left side. There is already a handicap space there for right side access. They need one for the left side for vans that have the passenger side for unloading so that they can get in & out safely. Mayor L. Chammings stated that the DPW will do the handicap parking space once they receive their hot box back to be able to fix the parking lot.

Committeewoman V. Rumsey stated that the “History of Stillwater” was an event held at the community center and it was well attended. She stated that the Recreation Commission, Gina, Tara & Beth, as well as Andy & Scott did a fantastic job, there was lots of information and it was a great turnout.

Committeewoman V. Rumsey stated that there are two new doors being installed on Thursday, September 7th at the community center. All the doors will be keyed the same. She asked if there were any updates on the roofing start date. Township Clerk L. Knott stated that she does not have a start date yet. She received two signed/sealed copies of the drawings and his additional plans. He said that within the next couple of days he would look though what was sent back to the town and let the township know. Upon initial review everything looked ok. Township Construction Official R. Bizik looked at the preliminary plans and will look over the drawings that were just received. The roofing company will pull the permit when ready.

Committeewoman V. Rumsey stated that she would like the Township Committee to consider raising fees for the community center for 2024. It would need to be done so by Ordinance soon. She stated that the community center is being used more frequently by various organizations weekly as well as frequent events and private parties. There are bills to pay for heating & cooling, kitchen repairs, etc.

Committeeman G. Scott

DPW

Committeeman G. Scott stated that the DPW was busy with weed whacking throughout the township and that they did a great job. He stated that they are working on repairing the catch basin on Mt. Benevolence Road.

Engineering

Committeeman G. Scott stated that the Township Engineers met and that the project should start sometime in September.

Mayor L. Chammings

Environmental Commission

Mayor L. Chammings stated that the Environmental Commission has not met so there is no update.

Legal

Mayor L. Chammings stated that there are a few things that she must discuss with Township Attorney H. Vex and she will leave anything else for him to report during his Attorney’s Report.

Engineering

Mayor L. Chammings stated that the engineers are working on preparing the Small Water Pollution Prevention Plan.

CERT

Mayor L. Chammings stated that a new member just joined CERT and was explained the requirements about being a new member. She stated that the next meeting will be held on September 27th.

Personnel

Mayor L. Chammings stated that there are township employees that are up for their 30/60/90-day review and that they will be completing them within the next week.

Mayor L. Chammings stated that she would like to add the Open Space report to the next agenda. She stated that there is a quote from the Land Conservancy for $13,500 for an open space and recreation update. 2006 was the last time it was completed.

Mayor L. Chammings stated that she received an email from a township resident saying how much they enjoyed the K9 demonstration. She also received a call from a resident thanking the DPW for fixing a rock wall issue. The resident said that the DPW employees were very professional, well trained and completed the work even though they were short staffed that day.

AMENDMENTS TO AGENDA:

Mayor L. Chammings stated that there was one amendment to the agenda; to add an Employee Education Request.

OLD BUSINESS

TAX IN REM FORECLOSURE UPDATE:

Township Attorney H. Vex stated he mailed the letters with the required service of certified mail with tracking, though they lost track of half of the letters. It is still court mandated to be sent via certified mail. Most people have been served now; 16 out of the 22 properties. He is just about finalized on the 16 properties. He will have a comprehensive report ready in two weeks.

PUBLIC HEARING AND FINAL ADOPTION

STILLWATER TOWNSHIP ORDINANCE 2023-17

AN ORDINANCE OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF STILLWATER TO PROHIBIT THE IMPROPER SPILLING, DUMPING OR DISPOSAL OF MATERIALS OTHER THAN STORMWATER IN THE TOWNSHIP STORM WATER SEWERS AND BASINS

WHEREAS, the Township Committee of the Township of Stillwater has been directed by the State of New Jersey to implement this Ordinance and must comply with said directive.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Stillwater, that the Township Code shall be amended as follows:

SECTION 1

A new Chapter shall be added to the Township Code as follows:

Chapter ___. STORM WATER SEWERS AND BASINS

§_____-1. Purpose.

An ordinance to prohibit the spilling, dumping, or disposal of materials other than stormwater to the municipal storm sewer system operated by the Township of Stillwater so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.

§_____-2. Definitions.

For the purpose of this Ordinance, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this Chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.

  1. Municipal separate storm sewer system (MS4) – a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, manmade channels, or storm drains) that is owned or operated by the Township of Stillwater or other public body, and is designed and used for collecting and conveying stormwater.
  2. Person – any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.
  3. Stormwater – water resulting from precipitation (including rain and snow) that runs off the land’s surface, is transmitted to the subsurface, is captured by separate storm sewers or other sewerage or drainage facilities, or is conveyed by snow removal equipment.

§_____-3. Prohibited Conduct.

The spilling, dumping, or disposal of materials other than stormwater to the municipal separate storm sewer system operated by the Township of Stillwater is prohibited. The spilling, dumping, or disposal of materials other than stormwater in such a manner as to cause the discharge of pollutants to the municipal separate storm sewer system is also prohibited.

§_____-4. Exceptions to Prohibition.

1. Waterline flushing and discharges from potable water sources.

2. Uncontaminated ground water (e.g., infiltration, crawl space or basement sump pumps, foundation or footing drains, rising ground waters).

3. Air conditioning condensate (excluding contact and non-contact cooling water).

  1. Irrigation water (including landscape and lawn-watering runoff).
  2. Flows from springs, riparian habitats and wetlands, water reservoir discharges and diverted stream flows.
  3. Residential car washing water, and residential swimming pool discharges.
  4. Sidewalk, driveway and street wash water.
  5. Flows from fire-fighting activities.
  6. Flows from rinsing of the following equipment with clean water:
    1. Beach maintenance equipment immediately following their use for their intended purposes; and
    2. Equipment used in the application of salt and de-icing materials immediately following salt and de-icing material applications. Prior to rinsing with clean water, all residual salt and de-icing materials must be removed from equipment and vehicles to the maximum extent practicable using dry cleaning methods (e.g., shoveling and sweeping). Recovered materials are to be returned to storage for reuse or properly discarded.
    3. Rinsing of equipment, as noted in the above situation is limited to exterior, undercarriage, and exposed parts and does not apply to engines or other enclosed machinery.

§_____-5. Enforcement.
This Ordinance shall be enforced by the New Jersey State Police, and all Township and County Officials whose duties permit municipal code enforcement.

§_____-6. Violations and Penalties.

Unless another penalty is expressly provided by New Jersey Statute, any person convicted of a violation of this section shall be punished for a first conviction thereof by a fine of not more than $100; for a second such conviction, such person shall be punished by a fine of not more than $200.

§_____-7. Severability.

Each section, subsection, sentence, clause and phrase of this Ordinance is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or holding of any such portion of this Ordinance to be unconstitutional, void, or ineffective for any cause, or reason, shall not affect any other portion of this Ordinance.

§_____-8. Effective Date.

This Ordinance shall be in full force and effect from and after its adoption and any publication as may be required by law.

SECTION 2

The Township Clerk shall take all necessary action to assure the Code is promptly updated to include this Ordinance.

SECTION 3

This Ordinance shall take effect immediately upon its passage.

AN ORDINANCE OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF STILLWATER REGARDING CONTAINERIZED YARD WASTE

WHEREAS, the Township Committee of the Township of Stillwater has been directed by the State of New Jersey to implement this Ordinance and must comply with said directive.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Stillwater, that the Township Code shall be amended as follows:

SECTION 1

A new Chapter shall be added to the Township Code as follows:

Chapter ___. CONTAINERIZED YARD WASTE

§_____-1. Purpose.

An Ordinance to establish requirements for the proper handling of yard waste in the Township of Stillwater so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.

§_____-2. Definitions.

For the purpose of this Ordinance, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this Chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.

  1. Containerized – means the placement of yard waste in a trash can, bucket, bag or other vessel, such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater.
  2. Person – any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.
  3. Street – means any street, avenue, boulevard, road, parkway, viaduct, drive, or other way, which is an existing State, county, or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.
  4. Yard Waste – means leaves and grass clippings.

§_____-3. Prohibited Conduct.

The owner or occupant of any property, or any employee or contractor of such owner or occupant engaged to provide lawn care or landscaping services, shall not sweep, rake, blow or otherwise place yard waste, unless the yard waste is containerized, in the street. If yard waste that is not containerized is placed in the street, the party responsible for placement of yard waste must remove the yard waste from the street or said party shall be deemed in violation of this ordinance.

§_____-4. Enforcement.
This Ordinance shall be enforced by the New Jersey State Police, and all Township and County Officials whose duties permit municipal code enforcement.

§_____-6. Violations and Penalties.

STILLWATER TOWNSHIP ORDINANCE 2023-19

AN ORDINANCE OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF STILLWATER APPROPRIATING $60,000.00 FOR SCBA TANKS FOR THE STILLWATER AREA VOLUNTEER FIRE DEPARTMENT

BE IT ORDAINED by the Township Committee of the Township of Stillwater, in the County of Sussex, New Jersey, AS FOLLOWS;

Section 1. The improvement(s) or purpose(s) described in Section 3 of this capital ordinance are hereby respectively authorized as general improvements to be made or acquired by the Township of Stillwater, New Jersey. For the said improvement(s) or purpose(s) stated in said Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriations made for said improvement(s) or purpose(s), said sums being inclusive of all appropriations heretofore made therefore and amounting in the aggregate to $60,000.00, which has heretofore been set aside for the improvement(s) or purpose(s) stated in Section 3 and now available therefore by virtue of provision in a previously adopted budget or budgets of the Township for capital improvement purposes.

Section 2. For the financing of said improvement(s) or purpose(s) and to meet the part of said $60,000.00 appropriations, the Township will use $56,000.00 from American Rescue Plan Act (ARPA) funds and $4,000 from the Capital Improvement Fund (C.I.F.), as described in Section 3.

Section 3. The purpose hereby authorized for the allocation of which said obligations are to be spent, the appropriation made for an estimated cost of each such purpose, and the estimated maximum amount of funds to be spent for such purpose, is respectively as follows:

WHEREAS, the Township Committee of the Township of Stillwater has been directed by the State of New Jersey to implement this Ordinance and must comply with said directive.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Stillwater, that the Township Code shall be amended as follows:

SECTION 1

A new Chapter shall be added to the Township Code as follows:

Chapter ___. PRIVATE STORM DRAIN INLET RETROFITTING

(Not Applicable to a residential lot with one single family house)

§_____-1. Purpose.

An ordinance requiring the retrofitting of existing storm drain inlets which are in direct contact with repaving, repairing, reconstruction, or resurfacing or alterations of facilities on private property, to prevent the discharge of solids and floatables (such as plastic bottles, cans, food wrappers and other litter) to the municipal separate storm sewer systems) operated by the Township of Stillwater so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.

§_____-2. Definitions.

For the purpose of this ordinance, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this Chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.

a. Municipal separate storm sewer system (MS4) – a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, manmade channels, or storm drains) that is owned or operated by the Township of Stillwater or other public body, and is designed and used for collecting and conveying stormwater.

b. Person – any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.

c. Storm drain inlet – an opening in a storm drain used to collect stormwater runoff and includes, but is not limited to, a grate inlet, curb-opening inlet, slotted inlet, and combination inlet.

d. Waters of the State – means the ocean and its estuaries, all springs, streams and bodies of surface or ground water, whether natural or artificial, within the boundaries of the State of New Jersey or subject to its jurisdiction.

§_____-3. Prohibited Conduct.

No person in control of private property (except a residential lot with one single family house) shall authorize the repaving, repairing (excluding the repair of individual potholes), resurfacing (including top coating or chip sealing with asphalt emulsion or a thin base of hot bitumen), reconstructing or altering any surface that is in direct contact with an existing storm drain inlet on that property unless the storm drain inlet either:

1 Already meets the design standard below to control passage of solid and floatable materials; or

2. Is retrofitted or replaced to meet the standard in Section 4 below prior to the completion of the project.

§_____-4. Design Standard

Storm drain inlets identified in Section 1 above shall comply with the following standard to control passage of solid and floatable materials through storm drain inlets. For purposes of this paragraph, “solid and floatable materials” means sediment, debris, trash, and other floating, suspended, or settleable solids. For exemptions to this standard see Section 4.3 below.

1. Design engineers shall use either of the following grates whenever they use a grate in pavement or another ground surface to collect stormwater from that surface into a storm drain or surface water body under that grate:

a. The New Jersey Department of Transportation (NJDOT) bicycle safe grate, which is described in Chapter 2.4 of the NJDOT Bicycle Compatible Roadways and Bikeways Planning and Design Guidelines (April 1996); or

b. A different grate, if each individual clear space in that grate has an area of no more than seven (7.0) square inches, or is no greater than 0.5 inches across the smallest dimension.

Examples of grates subject to this standard include grates in grate inlets, the grate portion (non-curb-opening portion) of combination inlets, grates on storm sewer manholes, ditch grates, trench grates, and grates of spacer bars in slotted drains. Examples of ground surfaces include surfaces of roads (including bridges), driveways, parking areas, bikeways, plazas, sidewalks, lawns, fields, open channels, and stormwater basin floors.

2. Whenever design engineers use a curb-opening inlet, the clear space in that curb opening or each individual clear space, if the curb opening has two or more clear spaces) shall have an area of no more than seven (7.0) square inches, or be no greater than two (2.0) inches across the smallest dimension.

3. This standard does not apply:

a. Where the municipal engineer agrees that this standard would cause inadequate hydraulic performance that could not practicably be overcome by using additional or larger storm drain inlets that meet these standards;

b .Where flows are conveyed through any device (e.g., end of pipe netting facility, manufactured treatment device, or a catch basin hood that is designed, at a minimum, to prevent delivery of all solid and floatable materials that could not pass through one of the following:

i. A rectangular space four and five-eighths inches long and one and one-half inches wide (this option does not apply for outfall netting facilities); or

ii. A bar screen having a bar spacing of 0.5 inches.

c. Where flows are conveyed through a trash rack that has parallel bars with one-inch (1″) spacing between the bars; or

d. Where the New Jersey Department of Environmental Protection determines, pursuant to the New Jersey Register of Historic Places Rules at N.J.A.C. 7:4-7.2(c), that action to meet this standard is an undertaking that constitutes an encroachment or will damage or destroy the New Jersey Register listed historic property.

§_____-5. Enforcement.

This Ordinance shall be enforced by the New Jersey State Police, and all Township and County Officials whose duties permit municipal code enforcement.

§_____-6. Penalties.

Any person(s) who is found to be in violation of the provisions of this Ordinance shall be subject to a fine not to exceed $100 for each storm drain that is not retrofitted to meet the design standard.

§_____-7. Severability.

Each section, subsection, sentence, clause and phrase of this Ordinance is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or holding of any such portion of this Ordinance to be unconstitutional, void, or ineffective for any cause, or reason, shall not affect any other portion of this Ordinance.

§_____-8. Effective Date.

This Ordinance shall be in full force and effect from and after its adoption and any publication as may be required by law.

SECTION 2

The Township Clerk shall take all necessary action to assure the Code is promptly updated to include this Ordinance.

§_____-2. Definitions.

For the purpose of this ordinance, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this Chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word “shall” is always mandatory and not merely directory. The definitions below are the same as or based on corresponding definitions in the New Jersey Pollutant Discharge Elimination System (NJPDES) rules at N.J.A.C. 7:14A-1.2.

a. Domestic sewage – waste and wastewater from humans or household operations.

b. Illicit connection – any physical or non-physical connection that discharges domestic sewage, non-contact cooling water, process wastewater, or other industrial waste (other than stormwater) to the municipal separate storm sewer system operated by the Township of Stillwater unless that discharge is authorized under a NJPDES permit other than the Tier A Municipal Stormwater General Permit (NJPDES Permit Number NJ0141852). Non-physical connections may include, but are not limited to, leaks, flows, or overflows into the municipal separate storm sewer system.

c. Industrial waste- non-domestic waste, including, but not limited to, those pollutants regulated under Section 307(a), (b), or (c) of the Federal Clean Water Act (33 U.S.C. §1317(a), (b), or (c)).

d. Municipal separate storm sewer system (MS4)- a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, manmade channels, or storm drains) that is owned or operated by the Township of Stillwater or other public body, and is designed and used for collecting and conveying stormwater. MS4s do not include combined sewer systems, which are sewer systems that are designed to carry sanitary sewage at all times and to collect and transport stormwater from streets and other sources.

 

e. NJPDES permit- a permit issued by the New Jersey Department of Environmental Protection to implement the New Jersey Pollutant Discharge Elimination System (NJPDES) rules at N.J.A.C. 7:14A.

f. Non-contact cooling water – water used to reduce temperature for the purpose of cooling. Such waters do not come into direct contact with any raw material, intermediate product (other than heat) or finished product. Non-contact cooling water may however contain algaecides, or biocides to control fouling of equipment such as heat exchangers, and/or corrosion inhibitors.

g. Person – any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.

h. Process wastewater – any water which, during manufacturing or processing, comes into direct contact with or results from the production or use of any raw material, intermediate product, finished product, byproduct, or waste product. Process wastewater includes, but is not limited to, leachate and cooling water other than non-contact cooling water.

i. Stormwater – water resulting from precipitation (including rain and snow) that runs off the land’s surface, is transmitted to the subsurface, is captured by separate storm sewers or other sewerage or drainage facilities, or is conveyed by snow removal equipment.

§_____-3. Prohibited Conduct.

No person shall discharge or cause to be discharged through an illicit connection to the municipal separate storm sewer system operated by the Township of Stillwater any domestic sewage, non-contact cooling water, process wastewater, or other industrial waste (other than stormwater).

§_____-4. Enforcement.

This Ordinance shall be enforced by the New Jersey State Police, and all Township and County Officials whose duties permit municipal code enforcement.

§_____-5. Penalties.

Any person(s) who is found to be in violation of the provisions of this Ordinance shall be subject to a fine not to exceed $100 for each storm drain that is not retrofitted to meet the design standard.

An ordinance requiring dumpsters and other refuse containers that are outdoors or exposed to stormwater to be covered at all times and prohibits the spilling, dumping, leaking, or otherwise discharge of liquids, semi-liquids or solids from the containers to the municipal separate storm sewer systems operated by the Township of Stillwater and/or the waters of the State so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.

§_____-2. Definitions.

For the purpose of this ordinance, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this Chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.

a. 1. Any person who controls whether owned, leased, or operated, a refuse container or dumpster must ensure that such container or dumpster is covered at all times and shall prevent refuse from spilling out or overflowing.

2. Any person who owns, leases or otherwise uses a refuse container or dumpster must ensure that such container or dumpster does not leak or otherwise discharge liquids, semi-liquids or solids to the municipal separate storm sewer systems operated by the Township of Stillwater.

§_____-4. Exceptions to Prohibition.

a. Permitted temporary demolition containers.

b. Litter receptacles (other than dumpsters or other bulk containers).

c. Individual homeowner trash and recycling containers.

d. Refuse containers at facilities authorized to discharge stormwater under a valid

NJPDES permit.

e. Large bulky items (e.g., furniture, bound carpet and padding, white goods placed

curbside for pickup).

§_____-5. Enforcement.

This Ordinance shall be enforced by the New Jersey State Police, and all Township and County Officials whose duties permit municipal code enforcement.

RESOLUTION 2023-164 STATEWIDE INSURANCE FUND- RESOLUTION TO JOIN (RENEW) THE FUND

WHEREAS, a number of local units have joined together to form the Statewide Insurance

Fund (“FUND”), a joint insurance fund, as permitted by N.J.S.A. 40A:10-36, et seq.; and

WHEREAS, (“LOCAL UNIT”) has

complied with relevant law with regard to the acquisition of insurance; and

WHEREAS, the statutes and regulations governing the creation and operation of joint insurance funds contain elaborate restrictions and safeguards concerning the safe and efficient administration of such funds; and

WHEREAS, the LOCAL UNIT has determined that membership in the FUND is in the best interest of the LOCAL UNIT.

WHEREAS the LOCAL UNIT agrees to be a member of the FUND for a period of three (3) years, effective from January 1, 2024 terminating on January 1, 2027 at 12:01 a.m. standard time; and

WHEREAS, the LOCAL UNIT has never defaulted on claims, if self-insured, and has not been canceled for non-payment of insurance premiums for two (2) years prior to the date of this Resolution.

NOW, THEREFORE, BE IT RESOLVED that the LOCAL UNIT does hereby agree to join the Statewide Insurance Fund; and

BE IT FURTHER RESOLVED that to the extent required by law, the Local Unit shall provide notice of the Indemnity and Trust Agreement to the Office of the State Comptroller; and

WHEREAS, the funding allotted to the project has been depleted and Township Committee desires Kathryn Wunder to continue to provide the necessary services as File Clerk; and

WHEREAS, there is $2,500.00 left in the File Clerk line available for the project; and

WHEREAS, the Township’s Chief Financial Officer has certified the funds are available for this purpose;

BE IT RESOLVED the Township Committee of the Township of Stillwater appoints Kathryn Wunder to continue to provide purging/filing/scanning assistance to the Construction Department at a rate of $20 per hour, as File Clerk, until reaching an additional total of $2,500.00 for the calendar year of 2023 beginning June 6, 2023.

A copy of this Resolution shall be placed on file with the Clerk of the Township.

The Resolution shall take effect immediately.

If any section, subsection, sentence, clause or phrase in this Resolution is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this resolution.

THEREFORE, BE IT RESOLVED that the Local Registrar of the Township of Stillwater approves the Local Registrar’s appointment of Valerie Ingles as Alternate Deputy Registrar as per N.J.S.A. 26:8-17.

THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Stillwater appoint Luke Kramer as Part-Time Recycling/Solid Waste effective September 9, 2023 on a “as needed basis” at a rate of $15.49 per hour.

BE IT FURTHER RESOLVED that this appointment was made at a meeting of the Township Committee on Tuesday, September 5, 2023.

RESOLUTION 2023-176 RESOLUTION TO AUTHORIZE PAYMENT OF REDEMPTION FOR BLOCK 3703 – LOT 6, 1024 RT 619

WHEREAS, on December 15, 2020 the Township of Stillwater Tax Collector sold to Pro Cap 8, FBO Firstrust Bank for Municipal Taxes on property known as Lien # 2020-016 Block 3703 Lot 6 and also known as 1024 Rt 619, and

WHEREAS, the Tax Collector has received redemption of said lien on August 31, 2023 and had deposited said sum in the current account of the Township of Stillwater.

NOW THEREFORE BE IT RESOLVED, by the Mayor and Committee of the Township of Stillwater that the Tax Collector be authorized to refund Pro Cap 8 in the amount of $ 31,602.45.

RESOLUTION 2023-177 RESOLUTION TO CANCEL TAXES ON PROPERTIES THE TOWNSHIP DID QUIT CLAIM DEEDS

WHEREAS, Stillwater Township had acquired properties thru Quit Claim Deeds, and

WHEREAS, the property taxes need to be canceled from these accounts.

DISCUSSION ITEMS:

2023 NJ League Conference

Mayor L. Chammings stated that the 2023 NJ League of Municipalities Conference would be held from November 14th – 16th if any of the members of the committee are interested in attending. Committeeman G. Scott stated that the seminars are very good. Committeewoman D. Delaney and Committeewoman V. Rumsey stated that they would be interested in attending the League conference. Mayor L. Chammings stated that she may go for one day but that if she was able to go then she would make her own arrangements. Municipal Clerk L. Knott stated that she would prepare the arrangements for Committeewomen D. Delaney and V. Rumsey to attend the league conference.

eCode Review

The Township Committee agreed that the eCode looks good and it is okay to proceed to the next step for the codification to be done.

Zoom

Committeeman G. Scott stated that he asked that Zoom be on the discussion for the meeting that evening. He stated that it isn’t mandatory for municipalities to have Zoom any longer and he would like the committee to consider ending it.

Committeeman P. Barta stated that people do utilize Zoom and it’s good for certain residents that have trouble coming in person to meetings to still be able to participate from home.

Mayor L. Chammings stated that Zoom is paid for though March 2024. It’s also been advertised through the end of this year that Zoom is available for the Township Committee meetings. Committeewoman V. Rumsey suggested revisiting the subject at the end of the year for discussion for next year.

PUBLIC SESSION (any subject – 3-minute limit)

Township Resident Mr. Bert Bodensieck asked if there would be a second property tax list on which properties are left. He is interested in Block 3501 Lot 2.03. Township Attorney H. Vex stated that they have everything that they need to close on that property, the people just haven’t responded at all. So that property will most likely be one of the ones still on the list.

Recreation Commission President T. Tosti stated that the Recreation Commission relies on Zoom quite a bit, it’s easier for them to attend the Township Committee meetings especially now that school is back in session.

Zoning Board member H. Montford stated that she also supports having zoom to attend meetings. She asked about redemption on block 3703 and asked if that was on the original tax list because she didn’t see it. Mayor L. Chammings responded that the property was previously out for tax sale and that Pro Cap had picked up the certificate at a tax sale in 2016. She stated that they continued to pay the taxes until the assumed owner of the property had redeemed the certificate and is going to be paying it all back. She stated that the tax collector would be able to answer more accurately who paid to redeem the property.

Township Resident Mr. Joseph Doherty stated that he spoke to the young man that was excessively riding his dirt bike up and down Old Schoolhouse Road. He stated that the young man was sympathetic and apologized. He stated that he was good for a few days but has now resumed riding excessively again.

Recreation Commission President T. Tosti stated that she also wanted to thank the Township Committee for supporting the Recreation Commission especially with all their new events that they have been hosting. She stated that the summer camp was amazing; she had great kids and great counselors this year. The K-9 addition was a huge success, the parents and other township residents really enjoyed it. She said that the history night was also very successful, they may plan another one in the next month sometime. She stated that the following events are also coming up:

9/17 Sussex County Day

9/28 Seniors Ice Cream Social

10/13 Movie “Hocus Pocus”

10/14 & 15 Garage Sale Weekend

10/22 Trunk or Treat 1pm

T. Tosti stated that they will also be showing the movie “The Lorax” as their spring movie in April, which will tie into doing their annual Clean Up Day.

PUBLIC SESSION CLOSED

Mayor L. Chammings stated that there was an Educational Request from township employee V. Ingles for $315 for a class that would benefit the township.
