REGULAR MEETING MINUTES

MARCH 4, 2025

A REGULAR MEETING of the Stillwater Township Committee was called to order by Mayor L. Chammings at 6:00 p.m. Mayor L. Chammings stated that this meeting is being held in compliance with the provisions of P.L. 1975, Ch. 231, Secs. 4 & 13 the Sunshine Law and that adequate notice of the meeting has been published in the New Jersey Herald as to the time, place, and date of meetings, and is posted in the usual location of posted notices in the municipal building as well as electronically on the township website.

EXECUTIVE SESSION: held in the Stillwater Township Municipal Building.

A MOTION was made by Committeeman D. Manser, seconded by Committeeman G. Scott, with all members in favor, to adopt the Resolution permitting the Committee to go into Executive Session at 6:01 p.m.

STILLWATER TOWNSHIP COMMITTEE

RESOLUTION FOR EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Stillwater, in the County of Sussex and State of New Jersey as follows:

1. The public shall be excluded from that portion of this meeting.

2. The general nature of the subject matter to be discussed is as follows: Attorney-Client, Contract, Public Safety

3. As nearly as can now be ascertained, the matter or matters to be discussed at this time will be disclosed to the public when such matters are resolved.

A MOTION was made by Deputy Mayor V. Rumsey and seconded by Committeewoman D. Delaney to go back into Regular Session at 6:52 P.M.

Township Attorney E. Bernstein stated that the record should reflect that all members of the governing body present, commencing from the Executive Session, are present to recommence to the open session along with the Township Attorney and Township Clerk. CFO T. Leonard was also present at the beginning of the executive session relating to a contract matter. There was an update on the ongoing negotiations with Teamsters Local 125; formal legal action will be taken later in the meeting. Updates were given by the township attorney on relative issues; no formal actions need to be taken at this point.

COMMITTEE REPORTS:

Committeeman George Scott

Committeeman G. Scott stated that two contracts have been completed; the Collective Bargaining Agreement between Stillwater Township and Teamsters Local 125 and the Gypsy Moth Contract.

Committeeman David Manser

Committeeman D. Manser stated that he attended the Board of Education meeting on February 10th. They have budget meetings set up for the budget committee. They are also working on strategic planning for issues that they have at the school, including septic system issues, cracks in the floors, etc. They are also planning their curriculum. There will be public session meetings on March 19th, April 1st, and April 7th starting at 6:30 pm. They last approximately 90 minutes. The public can hear what’s going on and have a chance to comment.

Committeewoman Dawn Delaney

Committeewoman D. Delaney stated that there was a special bicentennial meeting on February 25th between the Township Committee, Recreation Commission and the Historical Society. There will be 18 artisans on Main Street, a desk signing at white hall at 11:00 am, a proclamation, a new flag design to be displayed, tours, Stillwater Township School is putting together a time capsule to bury, a horse and carriage ride, and more from 11 – 1 pm. There will be a parade that will begin at Stillwater School and proceed down Stillwater Road, to 521, and then to Veterans Park. Veteran’s Park activities with food, games, and fireworks will be from 2:00 pm until dusk. The Fire Department will be present selling breakfast on Main Street, then food and a possible beer tent at the park. The next Bicentennial meeting will be on Tuesday, March 25th at 6:00 pm. All are welcome and invited to join to hear what’s being planned and give their thoughts and suggestions.

Committeewoman D. Delaney said at the regular Recreation Commission meeting they discussed all the different events coming up. Some of the events include Clean Up Day, Miss Stillwater (which will be prior to the Bicentennial event at the Community Center), Garage Sale weekend, the Easter Egg Hunt, a Veteran’s Breakfast, the Sheriff’s Office Senior Safety Series and more. She wanted to thank Mrs. Richardson for all of her hard work in planning the Valentine’s Day Dinner Dance, she stated that it was a very well attended event and everything was amazing.

Deputy Mayor Vera Rumsey

Deputy Mayor V. Rumsey stated that everything is going well at the Community Center. There are new “No Parking” signs in the back because people keep running over the ones that were there and parking there. The new signs are taller so hopefully that will help alleviate people parking there. There are also new signs on West End Ave before the sharp turns on both ends.

Deputy Mayor V. Rumsey stated the Fire Department had a walk through at the North Shore House so they are now familiar with the layout in case they ever receive a call there. There were 27 fire calls, 87 EMS calls, and the tri-pod reviewed their pre-planning and apparatus placement.

Mayor Lisa Chammings

Mayor L. Chammings stated that the Planning Board discussed the off-street and on-street parking Ordinances. They also discussed the Land Use Board survey and had a good discussion on it, the result being that the members felt that things should be kept the way they are now. They also welcomed two new members.

Mayor L. Chammings also attended the CERT meeting and stated that it was an interesting meeting. They had a speaker there from the Center for Prevention that discussed the use of Narcan. She told everyone what it was, how to use it, when it’s effective, and things to look for. There were 12-13 people in attendance so it was a good turnout.

Mayor L. Chammings also attended a Mayor’s Breakfast on Saturday at the Hampton Diner. She will discuss what they talked about the majority of the meeting later in the meeting as it involves one of the Resolutions on the agenda.

AMENDMENTS TO AGENDA:

Mayor L. Chammings added Resolution 2025-055 to the agenda.

Public Session Open 7:16 pm.

Township Resident C. Feenstra asked when the date of the bicentennial celebration would be. Mayor L. Chammings responded that it will be on June 7th. Main Street will be closed from 11 am – 1:30 pm for the Historical Society’s events, there will be a parade from downtown to Veteran’s Park, and events at Veteran’s Park from 2 pm – dusk. There is a rain date of June 8th.

ORDINANCE INTRODUCTION AND FIRST READING

ORDINANCE 2025-06

CAPITAL ORDINANCE APPROPRIATING $9,442.50

IN ADDITIONAL FUNDS FOR GUIDE RAIL FOR

MT. BENEVOLENCE PHASE 3 AND EXTENSION

BE IT ORDAINED by the Township Committee of the Township of Stillwater, in the County of Sussex, New Jersey, AS FOLLOWS;

Section 1. The improvements described in Section 3 of this capital ordinance are hereby respectively authorized as general improvements to be made or acquired by the Township of Stillwater, New Jersey. For the said improvements or purposes stated in said Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriations made for said improvements or purposes, said sums being inclusive of all appropriations heretofore made therefore and amounting in the aggregate to $9,442.50, which has heretofore been set aside for the improvement of purpose stated in Section 3 and now available therefore by virtue of provision in a previously adopted budget or budgets of the Township for capital improvement purposes.

Section 2. For the financing of said improvements or purposes and to meet the part of said $9,442.50 appropriations, the Township will use funding as described in Section 3.

Section 3. The improvements hereby authorized and the purpose for the allocation of which said obligations are to be spent, the appropriation made for an estimated cost of such purpose, and the estimated maximum amount of funds to be spent for such purpose, are respectively as follows:

The aforestated improvements or purposes where applicable, are in accordance with specifications on file in the office of the Township Clerk, which specifications are hereby approved.

Section 4. The following additional matters are hereby determined, declared, recited and stated:

  1. The said purposes described in Section 3 of this capital ordinance are capital expenses and are each a property or improvement which the Township may lawfully acquire or make as a general improvement, and no part of the cost thereof has been or shall be specifically assessed on property specially benefited thereby.
  2. The average period of usefulness of said purposes within the limitations of said Local bond Law and taking into consideration the respective amounts of the said obligations authorized for the several purposes, according to the reasonable life thereof computed by this capital ordinance, is twenty (20) years.

Section 5. This capital ordinance shall take effect ten (10) days after the first publication thereof after final adoption, as provided by said Local Bond Law.

Resolutions

RESOLUTION 2025-046

RESOLUTION IN SUPPORT OF SPRAYING FOR GYPSY MOTH

WHEREAS, the gypsy moth Lymantria dispar, dispar (LDD) has been found heavily defoliating tree and plant growth in the Township of Stillwater; and

WHEREAS, continued destruction of foliage may result in the loss of valuable forest lands and trees; and

WHEREAS, the Township Committee of the Township of Stillwater has determined that a gypsy moth control program should be instituted with the State of New Jersey Department of Agriculture and that application for any Federal or State funds available be authorized.

NOW THEREFORE BE IT HEREBY RESOLVED by the Township Committee of the Township of Stillwater that the LDD is declared to be a public nuisance and the protection of vegetation or plant life therefrom is deemed to be a subject matter of public welfare and that all measures deemed necessary, in compliance with the State of New Jersey Department of Agriculture recommendations, is hereby authorized to suppress this forest and shade tree pest.

I, Valerie Ingles, Clerk of the Township of Stillwater, County of Sussex, State of New Jersey, do hereby certify that this Resolution was adopted by the municipal governmental body at an open public meeting which was duly advertised to the citizens of the municipality in accordance with the law, pursuant to the Open Public Meetings Act, N.J.S.A. 10:4-9.

I also certify that this municipality has, or will, comply with the notice provisions required by N.J.S.A. 4:7-39.

I further certify the above to be a true and correct copy of a resolution adopted by the Stillwater Township Committee at a regular meeting of that body held on March 4, 2025.

A MOTION was made by Committeeman G. Scott and seconded by Mayor L. Chammings to adopt Resolution 2025-046.

Senior Inspector Howard Panton of the NJ Department of Agriculture explained that Stillwater has an infestation of gypsy moth egg masses that were identified in the fall. It will be detrimental when they start hatching and eating the trees and foliage. They will begin spraying in early May depending on weather conditions and temperature. The pesticide that they use is a naturally occurring pesticide. More information will be posted on the website or can be obtained at town hall. Letters will be going out to residents within the affected areas. They will begin spraying early in the morning, between 4:30-5 am, stop for the no-spray time between 7:45-8:45 am for the children getting to school, and continue until finished. They can hopefully get all the spraying completed in one day, depending on weather conditions, no malfunctions with the plane, etc.

Township Resident H. Montford asked if the pesticide would affect beehives. H. Panton responded that it does not affect beehives as it’s a naturally occurring pesticide found in dirt.

WHEREAS, the Township Committee adopted Ordinance# 2025-02 on February 4, 2025; and

WHEREAS, the Township Committee of the Township of Stillwater desires to set the specific salaries for full-time and part-time non-contract Township employees for the year 2025;

ELECTRICAL SUB-CODE OFFICIAL

THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Stillwater authorize the position of Substitute Electrical Sub-Code Official as needed with an hourly rate of $45.00 per hour as of March 1, 2025.

BE IT FURTHER RESOLVED that this position was authorized as of the meeting of the Township Committee on Tuesday, March 4, 2025.

RESOLUTION 2025-050

RESOLUTION AUTHORIZING PARTICIPATION OF STILLWATER TOWNSHIP IN

THE STATE DEVELOPMENT AND REDEVELOPMENT PLAN (State Plan) CROSS-ACCEPTANCE PROCESS

WHEREAS, the State Planning Act of 1985 (N.J.S.A. 52:18A-196 et. seq.) created a State Planning Commission and an Office of Planning Advocacy for the purpose of establishing a cooperative planning process that involves the full participation of state, county and local governments; and,

WHEREAS, the State Planning Act states that New Jersey needs integrated and coordinated planning in order to conserve its natural resources, to revitalize its urban centers, to provide affordable housing and adequate public facilities at a reasonable cost, to promote equal social and economic opportunity for New Jersey’s citizens, and to prevent sprawl and promote the suitable use of land; and,

WHEREAS, the primary duty and responsibility of the State Planning Commission under the State Planning Act is the preparation of a “State Development and Redevelopment Plan;” and,

WHEREAS, the State Planning Act also provides that the State’s municipalities are to have an essential role in the development of the State Plan through their participation in the Cross- acceptance process to be conducted under the Act; and,

WHEREAS, the Cross-acceptance process is the primary vehicle under the Act for promoting vertical coordination and integration of state, county and local plans by affording county and municipal governments a full and open opportunity to be involved in reconciling inconsistencies between state and local policies; and,

WHEREAS, the Board of County Commissioners of Sussex County has concluded that it is appropriate, necessary and in the County’s interest to fully participate in the development of the State Plan through the full and active participation of the County government, including in particular its Planning Board and its Department of Planning, in the Cross-acceptance process,

WHEREAS, the Governing Body of the Township of Stillwater has concluded that it is appropriate, necessary and in the municipality’s interest to fully participate in the development of the State Plan through the full and active participation of the Municipal government, including in particular its Planning Board and its Department of Planning, in the Cross-acceptance process,

NOW, THEREFORE, BE IT RESOLVED by the Stillwater Township Council of the County of Sussex as follows:

1. That the Municipal Planning Board is hereby authorized and directed to carry out the Cross-acceptance process pursuant to the State Planning Act, N.J.S.A. 52:18A-196 et. seq. and the State Planning Rules, N.J.A.C. 15:30 and any other rules promulgated by the State Planning Commission for this purpose:

That the Municipal Planning Board shall coordinate with the County or Negotiating Entity in their preparation of a proposed work program and schedule for municipal and county Cross-acceptance and the Negotiating Entity shall submit said work program and schedule to the New Jersey Office of Planning Advocacy by ;

3. That the Municipal Department of Planning shall provide staff assistance to the County Planning Board or Negotiating Entity in order to prepare a Cross-acceptance Response Template and successfully complete the Cross-acceptance process;

4. That all other Municipal Departments and Agencies shall cooperate with the Municipal and County Planning Board or Negotiating Entity and provide information and furnish such documents as may be required.

Mayor L. Chammings stated that the majority of the Mayor’s Breakfast was a discussion on this Resolution. Autumn Sylvester will be attending the next meeting to discuss the Resolution and answer any questions.

A MOTION was made by Committeeman G. Scott and seconded by Deputy Mayor V. Rumsey to move Resolution 2025-050 to the March 18, 2025 meeting for further consideration.

Mayor L. Chammings explained that the Deputy Tax Collector, D. Tighe, has submitted an educational request to take the Tax Collection 1 course as recommended by the Tax Collector. Committeeman G. Scott stated that he’s in support of any employee seeking further education which also benefits the township.

A MOTION was made by Committeeman G. Scott and seconded by Deputy Mayor V. Rumsey to approve the educational request for D. Tighe to take the Tax Collection 1 Course.

RESOLUTION 2025-051 RESOLUTION FOR GOVERNOR’S COUNCIL ON SUBSTANCE USE DISORDER FISCAL GRANT CYCLE OCTOBER 2020 – JUNE 2026

WHEREAS, the Governor’s Council on Substance Use Disorder (GCSUD) established the Municipal Alliances for the Prevention of Substance Use Disorder in 1989 to educate and engage residents, local government and law enforcement officials, schools, nonprofit organizations, the faith community, parents, youth and other allies in efforts to prevent substance use disorder in communities throughout New Jersey.

WHEREAS, The Township Council of the Township of Stillwater, County of Sussex, State of New Jersey recognizes that substance use disorder is a serious problem in our society amongst persons of all ages; and therefore has an established Municipal Alliance Committee; and,

WHEREAS, the Township Council further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent substance use disorder in our community; and,

WHEREAS, the Township Council has applied for funding to the Governor’s Council on Substance Use Disorder through the County of Sussex;

NOW, THEREFORE, BE IT RESOLVED by the Township of Stillwater, County of Sussex, State of New Jersey hereby recognizes the following:

  1. The Township Council does hereby authorize submission of a strategic plan for the Stillwater Municipal Alliance grant for fiscal year 2026 in the amount of:

RESOLUTION 2025-052 RESOLUTION TO AUTHORIZE REFUND OF TAXES FOR A 100% PERMANENT AND TOTALLY DISABLED VETERAN AT 921 PLYMOUTH LAKE DRIVE EAST, BLOCK 1001 LOT 39

WHEREAS, Block 1001 Lot 39 for 921 Plymouth Lake Drive East, Stillwater Township, and

WHEREAS, Mr. Frank Bley has been approved for a 100% Permanent and Totally Disabled Veteran as of December 12, 2024, by the Tax Assessor, and

WHEREAS, a refund for taxes paid in the amount of $ 2,250.30 for December’s portion and February taxes paid.

NOW THEREFORE BE IT RESOLVED, by the Mayor and Township Committee that at their regular meeting held March 4, 2025, at the Stillwater Township Municipal Building, 964 Stillwater Road, Stillwater, New Jersey.

RESOLUTION 2025053 RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF STILLWATER AUTHORIZING THE ISSUANCE OF RAFFLE LICENSE RA-2025-03 TO DOMESTIC ABUSE SERVICES INC. (DASI)

WHEREAS the following Raffle Application with required fees have been submitted for Township Committee approval;

WHEREAS said Raffle Applications have been provided to the Township Committee and New Jersey State Police for their review;

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Stillwater, County of Sussex, State of New Jersey, the following:

  1. The appropriate officials are hereby authorized to execute the findings and determination for the above application and shall forward same to the Legalized Games of Chance Control Commission (LGCCC) for review.
  2. That the above license shall be issued pending LGCCC approval, pursuant to N.J.A.C. 13.1 et seq.

APPROVAL OF THE CONSENT AGENDA

Committeeman G. Scott asked that in the future any item relating to money not be added to the Consent Agenda.

DISCUSSION ITEMS:

Land Sale Properties

Municipal Clerk V. Ingles stated that the Township will be starting the land sale with contiguous property owners. The Ordinance will be introduced at the March 18th meeting and will be adopted at the April 1st meeting.

PUBLIC SESSION (any subject – 3-minute limit) 7:40 p.m.

Township Resident H. Montford gave an update on the Zoning Board meeting and the upcoming March Zoning Board meeting. She also inquired why R. Bizik’s salary is higher for the fire inspector position than P. Murphy’s was. The Township Attorney suggested P. Murphy’s may have been pro-rated only paid for the time he was here; however, the committee could not give a definite answer at that time.

Township Resident K. Draghi asked about the asterisk on the salary resolution for the office manager position. Mayor L. Chammings stated that the position had to be added to the Resolution as there was one payment made in 2025. K. Draghi also noted that they have been hearing difficult cases at the Zoning Board meetings and that social media has been terrible with being used to stir up misinformation, accusations, etc.

Township Resident B. Doolittle asked if there was an update on Emmons Lane. Township Attorney E. Bernstein stated that they are still working on it.

ATTORNEY’S REPORT

Township Attorney E. Bernstein stated that he gave his updates during Executive Session

RESOLUTION 2025-054 AUTHORIZING PAYMENT OF BILLS

WHEREAS, the Chief Financial Officer has certified that funds are available in the proper account; and

WHEREAS, the Chief Financial Officer has approved payment upon certification from

the Township Department Heads that the goods and/or services have been rendered to the

Township;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Committee of the Township of Stillwater that the current bill lists, dated March 18, 2025, are on file and available for public inspection in the Office of the Chief Financial Officer and approved by the Chief Financial Officer for payment, be paid.

A MOTION was made by Deputy Mayor V. Rumsey and seconded by Committeeman G. Scott to adopt Resolution 2025-054, funds permitting.

Mayor L. Chammings noted that ¾ of the bills were county and school taxes.

RESOLUTION 2025-055

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF STILLWATER AUTHORIZING THE MAYOR TO EXECUTE AGREEMENT WITH STILLWATER DEPARTMENT OF PUBLIC WORKS (TEAMSTERS LOCAL 125)

WHEREAS, the Township Committee of the Township of Stillwater has reviewed and agreed with the terms of the negotiated 2025-2027 DPW Collective Bargaining Agreement; and

THEREFORE, BE IT RESOLVED that the Mayor is authorized to execute the DPW 2025-2027 Collective Bargaining Agreement on behalf of Stillwater Township.

A MOTION was made by Committeeman D. Manser and seconded by Deputy Mayor V. Rumsey to adopt Resolution 2025-055.

Mayor L. Chammings thanked Committeeman D. Manser and Township Attorney E. Bernstein for all their time and efforts in the union negotiations.
