WORKSHOP MEETING MINUTES
JUNE 25, 2024
A REGULAR MEETING of the Stillwater Township Committee was called to order by Mayor L. Chammings at 7:02 p.m. Mayor L. Chammings stated that this meeting is being held in compliance with the provisions of P.L. 1975, Ch. 231, Secs. 4 & 13 the Sunshine Law and that adequate notice of the meeting has been published in the New Jersey Herald as to the time, place, and date of meetings, and is posted in the usual location of posted notices in the municipal building as well as electronically on the township website.

Absent: Committeeman G. Scott
A MOTION was made by Committeewoman V. Rumsey and seconded by Committeewoman D. Delaney, to excuse Mr. Scott from the June 18th and June 25th meeting.

NEW BUSINESS:
RESOLUTION 2024-81B RETAIL LIQUOR LICENSE RENEWAL 2024-2025
WHEREAS, the Township Committee of the Township of Stillwater, County of Sussex and State of New Jersey, pursuant to the authority vested in it by an act of Legislature, has heretofore by ordinance, provided for the sale of alcoholic beverage in the Township of Stillwater; and
WHEREAS, the following named Liquor License holder has filed an application for the license renewal and the Municipal Clerk has received the Tax Clearance Certificate for this establishment and all fees have been paid.
NOW, THEREFORE, BE IT RESOLVED, that the following liquor license known as Plenary Retail Consumption License be granted renewal for the period of July 1, 2024 to June 30, 2025.

RESOLUTION 2024-86 RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE BIDS FOR THE SALE OF MUNICIPAL PROPERTY IDENTIFIED AS BLOCK 301, LOT 7, BLOCK 301, LOT 5, BLOCK 409, LOT 14 AND BLOCK 501, LOT 6
WHEREAS, by way of Ordinance 2024-08A, duly adopted on May 21, 2024, and pursuant to N.J.S.A. 40A:12-13, the Township of Stillwater (“Township”) authorized the sale of municipal property, specifically Block 301, Lot 7, Block 301, Lot 5, Block 409, Lot 14 and Block 501, Lot 6, which are not needed for public use, to the highest bidder(s) of the adjacent property owner(s) with minimum bids identified in said Ordinance; and,
WHEREAS, in accordance with Ordinance 2024-08A, duly adopted May 21, 2024, and pursuant to N.J.S.A. 40A:12-13(b)(5), the adjacent property owners were offered by way of auction, through proper notification and advertisement, for the purchase of the identified undersized municipally owned lots located in Stillwater Township; and,
WHEREAS, in accordance with the aforesaid notice, the following bids were received during the public auction advertised to take place on June 18, 2024:
WHEREAS, the Township desires to accept the bids received for the sale of Block 301, Lot 7, Block 301, Lot 5, Block 409, Lot 14 and Block 501, Lot 6, and to authorize the sale in accordance with the terms and conditions of Ordinance 2024-08A, including, but not limited to, that the property is being sold in an “AS IS” condition.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Stillwater in the County of Sussex and State of New Jersey that the Township hereby authorizes the acceptance of the bids submitted and noted above, as the highest bids for the purchase of municipal property identified as Block 301, Lot 7, Block 301, Lot 5, Block 409, Lot 14 and Block 501, Lot 6, in the Township of Stillwater; and,
BE IT FURTHER RESOLVED that that the Mayor and Township Clerk be and are authorized to execute a contract of sale, deed and any other documents as referenced and in accordance with the terms and conditions set forth in Ordinance 2024-08A, in a form that is acceptable to the Township Attorney.
A MOTION was made by Committeewoman V. Rumsey and seconded by Committeeman D. Manser to adopt Resolution 2024-86.
Township Attorney E. Bernstein stated that there were provisions that within 7 days of the auction the residents that made purchases were to provide deeds and title insurance to prove that they are the owners. So far none of the purchasers have provided that information. They need to get that information in ASAP and told that they might not be able to close in the 30 days. The Committee discussed handing a copy of the Ordinance out in the future at the land sales.

RESOLUTION 2024-87 RESOLUTION TO ACCEPT DONATION FROM DAVID & ROSE HOOGERHEYDE
WHEREAS the Township of Stillwater can use a commercial ice machine in the Community Center; and
WHEREAS, Mr. & Mrs. Hoogerheyde had a commercial ice machine no longer needed for their business; and
WHEREAS, Mr. & Mrs. Hoogerheyde spoke with the Deputy Mayor offering the Township the commercial ice machine and wanted to donate the commercial ice machine; and
NOW, THEREFORE BE IT RESOLVED, by the Mayor and Committee of the Township of Stillwater to accept the donation of the commercial ice machine from Mr. & Mrs. Hoogerheyde.
A MOTION was made by Committeewoman V. Rumsey and seconded by Committeewoman D. Delaney to adopt Resolution 2024-87.
A correction was made to the initial Resolution to change the word “freezer” to “ice machine”. Committeewoman V. Rumsey stated that she was told that they’re getting the ice machine as-is and that it’s in perfect working order. The value of a new ice machine ranges from $450-1,500. Mr. Bernstein instructed in the future when receiving donations to have the model #, make, height and potential value. The current ice machine in the Community Center is not working and being removed.

DISCUSSION
Township Attorney E. Bernstein stated that he has been working with the clerk regarding the Boat House liquor license as well as some issues with Mountain Shadows. He suggested inviting the SWAEC to attend a Township Committee meeting and do complete PR.
Township Attorney E. Bernstein stated that he would be drafting an excavation contract for Pierson for 992 Fairview Lake Road for the Committee members to please review the document and respond by Monday.
