REGULAR MEETING MINUTES

JUNE 18, 2024

A REGULAR MEETING of the Stillwater Township Committee was called to order by Mayor L. Chammings at 6:00 p.m. Mayor L. Chammings stated that this meeting is being held in compliance with the provisions of P.L. 1975, Ch. 231, Secs. 4 & 13 the Sunshine Law and that adequate notice of the meeting has been published in the New Jersey Herald as to the time, place, and date of meetings, and is posted in the usual location of posted notices in the municipal building as well as electronically on the township website.

Mayor L. Chammings stated that they would be having executive session first for the sole purpose of interviewing for the receptionist position.

EXECUTIVE SESSION: held in the Stillwater Township Municipal Building.

A MOTION was made by Committeewoman V. Rumsey and seconded by Committeewoman D. Delaney, with all members in favor, to adopt the Resolution permitting the Committee to go into Executive Session at 6:03 p.m.

STILLWATER TOWNSHIP COMMITTEE

RESOLUTION FOR EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Stillwater, in the County of Sussex and State of New Jersey as follows:

1. The public shall be excluded from that portion of this meeting.

2. The general nature of the subject matter to be discussed is as follows: Personnel, Contract, Attorney Client and Real Property

3. As nearly as can now be ascertained, the matter or matters to be discussed at this time will be disclosed to the public when such matters are resolved.

A MOTION was made by Committeewoman V. Rumsey and seconded by Committeewoman D. Delaney, with all members in favor, to go back into Regular Session at 6:55 P.M.

Township Attorney E. Bernstein stated to let the record reflect that all members of the governing body present commencing from Executive Session are present to recommence to the open session along with the Township Attorney and Township Clerk. The Committee met in executive session to discuss personnel matters, interviewing perspective candidates for the reception job. No formal action has been taken at this moment. The committee is reserving said decision for a further executive session to be conducted at the conclusion of this evenings meeting. A motion was made by Deputy Mayor V. Rumsey and seconded by Committeewoman D. Delaney with all members in favor to come out of executive session. With that being said, the Township Committee may resume their regular order of business at this time.

The Committee took a brief five-minute break before continuing on with the meeting.

A MOTION was made by Committeewoman V. Rumsey and seconded by Committeewoman D. Delaney, with all members in favor, to amend the agenda to have the land sale prior to the board of health meeting.

Mayor Chammings asked if there was anyone in attendance or at home who wished to bid on this lot. Daniel Bayles said they wished to bid $500 for the lot on behalf of Desirae Delucci who was away on vacation. Seeing no one else interested in bidding Mayor Chammings deemed the lot sold to Desirae Delucci via proxy Daniel Bayles.

Township Attorney E. Bernstein stated that the accepted bids would need to put down at least 10% of the money owed that evening in either cash, check or money order. He went on to read all of the requirements via Ordinance 2024-8A.

Mayor Chammings asked if there was anyone in attendance or at home who wished to bid on this lot. Daniel Bayles said he wished to bid $250 for the lot. Seeing no one else interested in bidding Mayor Chammings deemed the lot sold to Daniel Bayles.

Mayor Chammings asked if there was anyone in attendance or at home who wished to bid on this lot. Seeing as there were no contiguous lot owners present the lot was not sold.

Mayor Chammings asked if there was anyone in attendance or at home who wished to bid on this lot. Robert Taylor said he wished to bid $250 for the lot. Seeing no one else interested in bidding Mayor Chammings deemed the lot sold to Robert Taylor.

Mayor Chammings asked if there was anyone in attendance or at home who wished to bid on this lot. Laura Timony said she wished to bid $250 for the lot. Seeing no one else interested in bidding Mayor Chammings deemed the lot sold to Laura Timony.

A MOTION was made by Committeewoman D. Delaney and seconded by Committeeman D. Manser to return to regular business.

BOARD OF HEALTH MEETING

Mayor L. OLD BUSINESS:

ORDnance NO. 2024-10

AN ORDINANCE ADOPTING A REVISION AND CODIFICATION OF THE BOARD OF HEALTH ORDINANCES OF THE Township OF Stillwater, COUNTY OF Sussex, STATE OF NEW JERSEY

Be it ordained and enacted by the Board of Health of the Township of Stillwater, County of Sussex, State of New Jersey, as follows:

§ 420-1. Code adopted; existing ordinances continued.

Pursuant to N.J.S.A. 40:49-4, the Board of Health ordinances of the Township of Stillwater of a general and permanent nature adopted by the Board of Health of the Township of Stillwater, as revised and codified and consisting of Chapters 420 through 467, are hereby approved, adopted, ordained and enacted as “Part III of the Code of the Township of Stillwater,” hereinafter known and referred to as the “Code.” The provisions of the Code, insofar as they are substantively the same as those of the Board of Health ordinances in force immediately prior to the enactment of the Code by this ordinance, are intended as a continuation of such Board of Health ordinances and not as new enactments. This ordinance and the Code adopted hereby shall supersede and replace Chapters 420 through 467 of the 2005 Code of the Township of Stillwater, as amended and supplemented.

§ 420-2. Code on file; additions and amendments.

A. A copy of the Code has been filed in the office of the Township Clerk and/or the Board of Health Secretary and shall remain there for use and examination by the public until final action is taken on this ordinance. Following adoption of this ordinance, such copy shall be certified to by the Secretary of the Board of Health of the Township of Stillwater, as provided by law, and such certified copy shall remain on file in the office of the Board of Health Secretary and/or Clerk of the Township, to be made available to persons desiring to examine the same during all times while said Code is in effect.

B. Additions or amendments to Part III of the Code, when adopted in such form as to indicate the intent of the Board of Health to make them a part thereof, shall be deemed to be incorporated into Part III of such Code so that reference to the “Code of the Township of Stillwater” shall be understood and intended to include such additions and amendments.

§ 420-3. Notice; publication.

The Secretary of the Board of Health or the Clerk of the Township of Stillwater shall cause notice of the passage of this ordinance be given in the manner required by law. The notice of passage of this ordinance coupled with the filing of the Code in the office of Secretary of the Board of Health or the Clerk of the Township of Stillwater as provided in § 420-2 shall be deemed, held and considered to be due and legal publication of all provisions of the Code for all purposes.

§ 420-4. Severability.

Each section of this ordinance and Part III of the Code and every part of each section is an independent section or part of a section, and the holding of any section or a part thereof to be unconstitutional, void or ineffective for any cause shall not be deemed to affect the validity or constitutionality of any other sections or parts thereof.

§ 420-5. Repealer.

A. Board of Health ordinances or parts of ordinances inconsistent with the provisions contained in Part III of the Code adopted by this ordinance are hereby repealed; provided, however, that such repeal shall only be to the extent of such inconsistency, and any valid legislation of the Board of Health of the Township of Stillwater which is not in conflict with the provisions of the Code shall be deemed to remain in full force and effect.

B. The following Board of Health ordinances have been excluded from the Code and specifically repealed:

(1) Former Chapter 452, Plumbing, of the 2005 Code.

(2) Former Chapter 467, Water Supply, of the 2005 Code.

§ 420-6. Ordinances saved from repeal.

The adoption of Part III of this Code and the repeal of ordinances provided for in § 420-5 of this ordinance shall not affect the following ordinances, rights and obligations, which are hereby expressly saved from repeal:

A. Any Board of Health ordinance adopted subsequent to December 5, 2017.

B. Any right or liability established, accrued or incurred under any legislative provision prior to the effective date of this ordinance or any action or proceeding brought for the enforcement of such right or liability.

C. Any offense or act committed or done before the effective date of this ordinance in violation of any legislative provision of the Board of Health or any penalty, punishment or forfeiture which may result therefrom.

D. Any prosecution, indictment, action, suit or other proceeding pending or any judgment rendered, prior to the effective date of this ordinance, brought pursuant to any legislative provision of the Board of Health.

E. Any franchise, license, right, easement or privilege heretofore granted or conferred by the Board of Health.

§ 420-7. Changes in previously adopted ordinances.

A. In preparing the revision and codification of the Board of Health ordinances pursuant to N.J.S.A. 40:49-4, certain minor grammatical and nonsubstantive changes were made in one or more of said ordinances. It is the intention of the Board of Health that all such changes be adopted as part of the Code as if the ordinances so changed had been formally amended to read as such.

B. In addition, the changes, amendments or revisions as set forth in Board of Health Schedule A attached hereto and made a part hereof are made herewith, to become effective upon the effective date of this ordinance. (Chapter and section number references are to the Board of Health ordinances as they have been renumbered and appear in the Code.)

C. Nomenclature changes. Throughout Part III of the Code, the following titles have been updated as follows:

(1) References to “Road Department” are amended to read “Department of Public Works.”

(2) References to “Map Filing Law (N.J.S.A. 46:23-9.9 et seq.)” are amended to read “Map Filing Law (N.J.S.A. 46:23-9.9 et seq.).”

§ 420-8. Titles and headings; editor’s notes.

A. Chapter and article titles, headings and titles of sections and other divisions of Part III of the Code are inserted in the Code and may be inserted in supplements to the Code for the convenience of persons using the Code and are not part of the legislation.

B. Editor’s notes indicating sources of sections, giving other information or referring to the statutes or to other parts of the Code are inserted in the Code and may be inserted in supplements to the Code for the convenience of persons using the Code and are not part of the legislation.

§ 420-9. Altering or tampering with Code; violations and penalties.

It shall be unlawful for anyone to change, alter or tamper with Part III of the Code in any manner which will cause the laws of the Board of Health of the Township of Stillwater to be misrepresented thereby. Anyone violating this section shall be subject, upon conviction, to a fine of not less than $5 nor more than $500.

§ 420-10. When effective.

This ordinance shall take effect immediately upon passage and publication according to law.

COMMITTEE REPORTS:

Committeeman David Manser

Board of Education

Committeeman D. Manser stated that the Board of Education meeting was on June 3rd and was a short meeting. He stated that they discussed the end of the school year, adapting to changes in the budget, they had a couple of retirements and are looking forward to the summer.

Recreation Commission

Committeeman D. Manser stated that Stillwater Day was a huge success. Miss Stillwater had four excellent ladies enter. Paige DeCaro was crowned Miss Stillwater 2024. All four were very well spoken. There were lots of good vendors and activities happening. The Fire Department donated all the food, there was no charge to anyone. The Recreation Commission did a fantastic job.

Recycling Center

Committeeman D. Manser stated that an extra employee is assigned to the recycling dumpster. He’s a college student and has been checking the items going into the recycling bin. A lot of farm equipment has been tossed in with recycling when it’s not recyclable material. The MUA has threatened to turn Stillwater Township down or start charging us for bringing the recycling there. He’s doing a great job sifting through everything.

Committeewoman Dawn Delaney

Planning Board

Committeewoman D. Delaney stated that the Planning board meeting was cancelled for May.

Recreation Committee

Committeewoman D. Delaney stated that in addition to what Committeeman D. Manser said that they are also doing the repairs and relining the tennis courts.

Finance

Committeewoman D. Delaney stated that she spoke with the CFO regarding the capital budget. The Chevy Silverado has been purchased for the DPW, the enclosed trailer has been ordered, engineer has been contacted for the paving, majority of the wiring at the community center has been completed. There is $1,200 balance from the 2023 LRIG grant. They discussed purchasing a wheelchair accessible picnic table for outside of the community center, cushions for the chairs and paint for the shed. They also discussed the Bond Anticipation Note (BAN) which is due in July. She is going to meet with the CFO, Committeeman D. Manser and Recreation Commission Chair Tara Tosti on Thursday to discuss the bicentennial budget.

Deputy Mayor Vera Rumsey

Zoning Board

Committeewoman V. Rumsey stated that the zoning board meeting was a light meeting.

Emergency Services

Committeewoman V. Rumsey stated that the new firetruck is coming on Friday. They have been busy transferring tools off of the old truck.

Community Center

Committeewoman V. Rumsey stated that they are going to paint the shed black then a local teen will paint a mural on three sides of the shed. Motion lights will also be installed over the doors. The shed will house the trash and recycling bins so they can get rid of the dumpsters.

Committeewoman V. Rumsey stated that there are several events being hosted there now including chair yoga. There will be a movie in the park on Friday which will be held in the community center. She stated that the BBQ pit will be taken out shortly. DPW will enforce the roof of the structure that’s over the BBQ pit and slot the three sides. A handicap accessible table will be put under it. They will also be ordering a new fridge since the current one is on its last leg.

Mayor Lisa Chammings

Environmental Commission

Mayor L. Chammings stated that there was a presentation by the Paulinskill Partnership Wild & Scenic River Project. The Environmental Commission has asked them for a more detailed presentation or resolution and to also include how it will affect the residents. If they feel that it is something that should be pursued, they will forward the information onto the Township Committee for further consideration. There will be no meeting in July. There will be two presentations at the August meeting one being Mr. Lippincott’s stream water study. The stream study began compiling data since the 1980s. Mr. Lippincott is going to go through the data to decide what is helpful and what is not. Mayor L. Chammings stated that she has also been made aware of gypsy moth concerns, unfortunately this area was listed as not needing treatment this year. The areas that were designated as needed it have already been treated. She asked anyone with concerns to email the township clerk with the location.

CERT

Mayor Chammings stated that there was a brief CERT meeting on May 22nd. The EOP reviewed the shelter annex, they need to make changes then get into the EOP. There was going to be a heat advisory presentation but they decided to hold off on the presentation until the next meeting.

Mayor Chammings stated that the OEM meeting was on June 6th. The County is rolling out “Regroup” instead of the current system that they’re using called Rave. With this new system, everyone is initially in it but will receive a text and can opt out. So, there is no need to sign up. There was a utility discussion but there are no gas lines in Stillwater so it didn’t pertain to them.

Personnel

Mayor Chammings stated that over 50 applications were received for the receptionist position. The township committee narrowed the applicants down to nine for an initial interview and then they interviewed the final four that evening. They will have a discussion during executive session to decide who to offer the position to.

Mayor Chammings noted that Mrs. Vosper attended the meeting and stated that the articled she had in the Journal was very interesting. She encouraged everyone to get a copy of the Journal so that they could read it.

Mayor Chammings stated that all the Mayors are invited to meet with Mr. Hutchensen to discuss the new school budgets. Committeeman D. Manser will also attend the meeting.

Mayor Chammings stated the Jack Degroot did a farmland preservation presentation and is currently updating the formula so that farmers will get more for entering the program then they have in the past.

Township Resident Dimitri Gatanas asked if the Planning Board would still be having their meeting the next evening even though it’s a holiday. Mayor Chammings replied that the planning board meeting is still scheduled for June 19th.

(4) Former Chapter 195, Article I, Fire Prevention Code; Storage of Materials, of the 2005 Code, as amended by Ord. No. 2008-3, adopted April 1, 2008.

(5) Former Chapter 195, Article II, Uniform Fire Code, of the 2005 Code.

(6) Former Chapter 321, School Bus Shelters, of the 2005 Code.

(7) Former Chapter 363, Towing and Wreckers, of the 2005 Code, as amended by Ord. No. 2008-9, adopted September 16, 2008.

(8) Former Chapter 382, Article I, Tree Cutting for Commercial Wood Products, of the 2005 Code.

§ 1-6. Ordinances saved from repeal.

The adoption of this Code and the repeal of ordinances provided for in § 1-5 of this ordinance shall not affect the following ordinances, rights and obligations, which are hereby expressly saved from repeal:

G. Any ordinance or resolution appropriating money or transferring funds, promising or guaranteeing the payment of money or authorizing the issuance and delivery of any bond or other instruments or evidence of the Township’s indebtedness.

H. Ordinances authorizing the purchase, sale, lease or transfer of property or any lawful contract, agreement or obligation.

I. The levy or imposition of taxes, assessments or charges or the approval of the municipal budget.

J. The dedication of property or approval of preliminary or final subdivision plats.

K. All currently effective ordinances pertaining to the rate and manner of payment of salaries and compensation of officers and employees.

L. Any ordinance adopting or amending the Zoning Map.

M. Any ordinance relating to or establishing a pension plan or pension fund for municipal employees.

§ 1-7. Changes in previously adopted ordinances.

A. It shall be unlawful for anyone to change, alter or tamper with the Code in any manner which will cause the laws of the Township of Stillwater to be misrepresented thereby. Anyone violating this section shall be subject, upon conviction, to one or more of the following penalties: a fine of not more than $2,000, imprisonment for not more than 90 days or a period of community service not exceeding 90 days, in the discretion of the Judge imposing the same.

§ 1-10. When effective.

This ordinance shall take effect immediately upon final passage and publication as provided by law.

Mayor Chammings requested that Resolution 2024-81, 2024-83 and 2024-84 be removed from the consent agenda for further discussion.

DISCUSSION ITEMS:

Tractor Trailers

Mayor Chammings stated that the large signs from the Sheriff’s office were placed on Stillwater Road by the Municipal Building and at Mt Benevolence/Chandler Road. There were two tractor trailers pulled over that day by the sheriff’s department.

Newsletter

Committeewoman D. Delaney and Municipal Clerk V. Ingles spoke regarding the newsletter. The committee needs to decide what information that they want in it, if they want it strictly online or delivered to each resident’s mailbox, how frequently they would like to send out a newsletter, etc.

Remainder Of 2023 LRIG

Committeewoman V. Rumsey stated that for the remainder of the LRIG grant that they will get the handicap accessible picnic table to go at the community center, paint for the shed and two motion lights to go above the shed entrance.

Committeewoman V. Rumsey stated that she also wanted to purchase a new refrigerator to go in the community center since the current one has been failing. The one that she recommends is $1,020 on Amazon and would come out of building and grounds. She measured and there is enough room to fit the fridge next to the freezer. The fridge is also large enough to hold sheet cakes and trays of food. She had additional refrigerators quotes as well to compare.

A MOTION was made by Committeewoman V. Rumsey and seconded by Committeewoman D. Delaney, to approve the purchase of a refrigerator not to exceed $1,600 pending funds available per the CFO.

SWAEC- Auction Results & Supplier Agreement

Mayor L. Chammings stated that the SWAEC did provide a lower bid price then JCP&L. She recommended putting information on the website and in the newsletter to get feedback from the residents if it is something that they would like to participate in since everyone would be initially added but are able to opt out. The committee agreed that they need to review the agreement further and send to the attorney for review. They moved their decision to the July meeting.

Fire Truck Payment

Mayor L. Chammings stated that the CFO has to release payment in full on Friday when the fire truck is delivered. The Committee agreed to discuss in Executive Session and will then take formal action.

Township Resident J. Doherty asked if the committee still does the flag salute at the start of the meeting. Mayor L. Chammings stated that the meeting started at 6:00pm for executive session which is when they did the flag salute so that’s why he wasn’t there when it was done. The flag salute is done at the beginning of every meeting.

Township Resident B. Bodensieck asked if there as an update on the tax in-rems. Township Attorney E. Bernstein responded that legislature may move forward. If they don’t prior to the budget being adopted then we will be waiting awhile. It is currently sitting in the Senate.

Township Resident M. Vosper asked about the SWAEC agreement, if it would be the same as the last go around. She stated that the rate was higher than JCP&L last time and there were lots of angry people because they didn’t even know the name of the company and were just enrolled. She stated that if you’re already using a third-party provider that it doesn’t affect you.

Township Resident D. Gatanas stated that he wanted to notify the committee that Stillwater Day was a great success. He was there as a vendor selling plants from his shop. He stated that a Murder Mystery Dinner would be coming up at the Stillwater Fire House. The cost is $85 and it will benefit the Historical Society. There will also be a square dance on July 19th at Vass Farmstead in Hardwick.

Mr. Gatanas also discussed the struggles that continue with the traffic light located at 916 Maple Ave. He also discussed that he received a letter from the Zoning Board Attorney and a notice of violation from the Zoning Officer regarding his business at 901 Main Street. He stated that AA has been having two meetings a week there for years and he will need to tell them that they cannot meet there any longer according to the notice of violation. He will attend the Zoning Board Meeting to discuss his plan for the building.

Township Attorney E. Bernstein stated that the matter is pending the zoning board meeting so the Township Committee cannot comment at this time.

Township Resident S. Michelman stated that in her opinion the AA meetings have been hosted at the church for a long time so she doesn’t understand why they can’t continue.

Township Resident S. Wycoff stated that he would like to use the community center to teach karate a couple nights a week over the summer for teens/adults. He stated that he holds a blackbelt in a couple different arts and is in the process of getting insurance. The township committee stated that would be a great idea, that he needs to provide the insurance and pay $100 per year to host the classes.

Township Resident T. Calvan stated that he just wanted to say sorry for disrupting the meeting (he was attending via zoom and didn’t have his microphone off at first).

ATTORNEY’S REPORT

Township Attorney E. Bernstein stated that the only report that has will be discussed in Executive Session.

RESOLUTION 2024-85 AUTHORIZING PAYMENT OF BILLS

WHEREAS, the Chief Financial Officer has certified that funds are available in the proper account; and

WHEREAS, the Chief Financial Officer has approved payment upon certification from

the Township Department Heads that the goods and/or services have been rendered to the

Township;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Committee of the Township of Stillwater that the current bill lists, dated June 18, 2024, are on file and available for public inspection in the Office of the Chief Financial Officer and approved by the Chief Financial Officer for payment, be paid.

Mayor L. Chammings noted that all four candidates were excellent applicants, and that it was a very difficult decision to make.

A MOTION was made by Committeewoman V. Rumsey and seconded by Committeewoman D. Delaney to approve the CFO to sign the purchase order per the agreement and addendum for the full amount of the fire truck.

Committeeman D. Manser asked if the fire department examined the truck and if it’s all good to go. Committeewoman V. Rumsey stated that they do and that the truck will be delivered on Friday at 6:00pm. The committee asked V. Ingles to have Deputy Fire Chief S. Sugar to ask the County to write a letter of intent and that they commit to paying the $50,000 for the fire truck in September once they receive their grant money and that they will be accepting the vehicle as is.
