REGULAR MEETING MINUTES

APRIL 15, 2025

A REGULAR MEETING of the Stillwater Township Committee was called to order by Mayor L. Chammings at 6:05 p.m. Mayor L. Chammings stated that this meeting is being held in compliance with the provisions of P.L. 1975, Ch. 231, Secs. 4 & 13 the Sunshine Law and that adequate notice of the meeting has been published in the New Jersey Herald as to the time, place, and date of meetings, and is posted in the usual location of posted notices in the municipal building as well as electronically on the township website.

EXECUTIVE SESSION: held in the Stillwater Township Municipal Building.

A MOTION was made by Deputy Mayor V. Rumsey, seconded by Committeeman D. Manser, with all members in favor, to adopt the Resolution permitting the Committee to go into Executive Session at 6:07 p.m.

STILLWATER TOWNSHIP COMMITTEE

RESOLUTION FOR EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Stillwater, in the County of Sussex and State of New Jersey as follows:

1. The public shall be excluded from that portion of this meeting.

2. The general nature of the subject matter to be discussed is as follows: Attorney-Client, Contract, and Litigation/Potential Litigation

3. As nearly as can now be ascertained, the matter or matters to be discussed at this time will be disclosed to the public when such matters are resolved.

A MOTION was made by Deputy Mayor V. Rumsey and seconded by Committeeman D. Manser to go back into Regular Session at 6:59 P.M.

Township Attorney E. Bernstein stated that the record should reflect that all members of the governing body present, including Committeewoman D. Delaney via Zoom, commencing from the Executive Session, are present to recommence the open session along with the Township Attorney and Township Clerk. There was a discussion regarding ongoing issues with Affordable Housing, regarding the electric aggregation program, regarding cell tower issues, and other attorney-client privilege matters. No formal action needs to be taken at this time.

PUBLIC HEARING OF THE 2025 MUNICIPAL BUDGET- TAMMY LEONARD, CFO

RESOLUTION 2025-070

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF STILLWATER AUTHORIZING READING OF THE MUNICIPAL BUDGET BY TITLE AND PROVIDING FOR PUBLIC HEARING ON THE BUDGET ADOPTION

WHEREAS, N.J.S.40A:4-8 provides that the budget may be read by title only at the time of the public hearing if a resolution is passed by not less than a majority of the full Governing Body, provided that at least one (1) week prior to the date of public hearing a complete copy of the approved budget, as advertised, has been posted in the Municipal Building, the Official Municipal web-site and copies have been made available by the Clerk to persons requesting them; and

WHEREAS, these conditions have been met;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of the Township of Stillwater, County of Sussex, State of New Jersey, that the 2025 Municipal Budget shall be read by title at this public hearing for same.

A MOTION was made by Deputy Mayor V. Rumsey and seconded by Committeeman D. Manser to adopt Resolution 2025-070.

Amanda Garris, CPA introduced herself to the public as the manager on the account at NISIVOCCIA for Stillwater. She commended the Township’s efforts in preparing the municipal budget. She said the budget has been reviewed and signed off on by NISIVOCCIA. The budget is found in compliance with budget guidelines. A state review was not required for the 2025 budget. The budget is within the statutory appropriation cap and the tax levy cap as required by the state of NJ. There is nothing noted in this budget that would place an unnecessary burden on future township budgets. The Township is continuing to fund current and future capital needs while paying down existing debt.

RESOLUTION 2025-070A

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF STILLWATER ADOPTING THE 2025 MUNICIPAL BUDGET

BE IT RESOLVED by the Governing Body of the Township of Stillwater, County of Sussex, that the budget herein before set forth is hereby adopted and shall constitute an appropriation for the purposes stated of the sums therein set forth as appropriations, and authorization of the amount of $2,156,339.33 for municipal purposes.

A MOTION was made by Mayor L. Chammings and seconded by Deputy Mayor V. Rumsey, with all members in favor, to open discussion on Resolution 2025- 070A to the public.

Township Resident L. Sylvester stated that the school budget between last year and this year is marginal. The school taxes have increased over the years due to a lack of state support.

PRESENTATION: 2024 AUDIT – AMANDA GARRIS, CPA, AND TAMMY LEONARD, CFO

Amanda Garris presented the 2024 municipal audit. She explained that the fund balance increased slightly and remains stable at just under four million dollars ($4,000,000). The tax collection rate is 97.93%. Currently, there is one million seven hundred seventy-eight dollars ($1,778,000) in debt, which is in the form of a bond anticipation note. The comments and recommendations are the same as in prior years. The first is segregation of duties; based on the township’s size, this wouldn’t be removed from the report. Tax title liens recommendation; as of December 31, 2024, the township has 82 liens, which are approximately $487,000 of open receivables. It’s recommended that the records for the township liens continue to be reviewed, and measures to collect or foreclose on the liens held by the township be taken. There was one management suggestion over the review of the COVID-19 federal funding. The Township may undergo a review of its COVID-19 funding by the federal government. They suggest that the Township ensure that the funds are utilized in accordance with the applicable federal requirements, especially with respect to procurement. They also recommend that the funds be separately accounted for in the Township’s accounting records. Ms. Garris thanked the Township for allowing them to complete the audit again this year, and that it’s been wonderful working with the township and staff.

GOVERNING BODY CERTIFICATION OF THE ANNUAL AUDIT

RESOLUTION 2025-071

WHEREAS, N.J.S.A .40a:5-4 requires the governing body of every unit to have made an annual audit of its books, accounts and financial transactions; and

WHEREAS, the Annual Report of Audit for the year 2024 has been filed by a Registered Municipal Accountant and with the Municipal Clerk pursuant to N.J.S.A .40A:5-6, and a copy has been received by each member of the governing body; and

WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and

WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6-5, a regulation requiring that the governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Comments and Recommendations”; and

WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual Report of Audit, and specifically the sections of the annual Audit entitled “Comments and Recommendations”, as evidenced by the group affidavit form of the governing body attached hereto; and

WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C .5:30-6-5; and

WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and

WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provision of the R.S. 52:27BB-52 to wit:

 

R.S. 52:27BB-52: A local officer or member of the local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the Director (Director of Local Government Services), under provisions of this Article, shall be guilty of a misdemeanor and upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year or both, in addition shall forfeit his office.

NOW, THEREFORE, BE IT RESOLVED, that the Township Committee of the Township of Stillwater, hereby states that it has complies with N.J.A.C. 5:30-6-5 and does hereby submit a certified copy of the resolution and the required affidavit to said Board to show evidence of said compliance.

ACCEPTING THE CORRECTIVE ACTION PLAN

CFO T. Leonard noted that the township is moving ahead with 30 of the township’s liens this year.

RESOLUTION 2025-072

 

RESOLUTION APPROVING SUBMISSION OF THE CORRECTIVE ACTION PLAN FOR THE YEAR ENDED DECEMBER 31, 2024 TO THE STATE OF NEW JERSEY, DIVISION OF LOCAL GOVERNMENT SERVICES

WHEREAS, all municipalities operating under the Local Fiscal Affairs Law must prepare and submit a Corrective Action Plan as part of their annual audit process, and

WHEREAS, the Township of Stillwater has by Resolution accepted the 2024 audit prepared and presented by the Township Auditors, and

WHEREAS, Tammy Leonard, the Chief Financial Officer for the Township of Stillwater, has prepared a Corrective Action Plan to address the findings and recommendations for the 2024 audit and presented copies of same to the Township Committee,

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Stillwater, New Jersey that the Corrective Action Plan, attached hereto and made a part hereof, be approved for submission to the Division of Local Government Services.

AMENDMENTS TO AGENDA:

Mayor L. Chammings stated that Resolution 2025-077 needed to be added to the agenda. Committeeman G. Scott explained that it was brought to his attention that the generator at the fire house is no longer working and asked if the fire house is still used as a shelter. Mayor L. Chammings stated that she could comment on that now, the Community Center is the designated shelter for Stillwater Township. She will check to see if it’s under the Hazard Mitigation Plan to see if the Township can help, and report back.

OLD BUSINESS:

PUBLIC HEARING & FINAL ADOPTION

ORDINANCE 2025-08

ORDINANCE PROVIDING FOR VARIOUS IMPROVEMENTS OR PURPOSES TO BE UNDERTAKEN BY THE TOWNSHIP OF STILLWATER, IN THE COUNTY OF SUSSEX, NEW JERSEY, AND APPROPRIATING $587,100 THEREFOR FROM VARIOUS SOURCES.

BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF STILLWATER, IN THE COUNTY OF SUSSEX, NEW JERSEY, AS FOLLOWS:

The improvements or purposes described in Section 2 of this ordinance are hereby authorized as general improvements to be made or acquired by The Township of Stillwater, in the County of Sussex, New Jersey, and there is hereby appropriated therefor the sum of $587,100 to the extent (a) $25,000 from the Asphalt Overlay Reserve, (b) $164,650 from the Capital Improvement Fund, (c) $30,000 from the DPW Equipment Reserve, (d) $40,000 from the Oil and Stone Rescue, (e) $25,000 from the Reserve for Parks Projects, (f) $48,000 from Capital Fund Balance (g) $164,760 from the proceeds of an NJDOT grant, (h) $45,240 from the proceeds of obligations of the Township heretofore issued under bond ordinance nos. 22-07 ($35,240) and 23-06 ($10,000) and (i) $44,450 from monies available under fully-funded ordinance nos. 23-07 ($2,700), 24-12 ($35,000), 23-19 ($4,000) and 24-09 ($2,750).

The improvements hereby authorized and the purposes for the financing of which the appropriation is made as provided in Section 1 of this ordinance including, without limitation, the following: (a) the acquisition by purchase of new and additional equipment including a mower, vibrating roller, blower and front-end loader for use by the Department of Public Works of the Township, turnout gear, radios and a thermal imaging drone for use by the Fire Department of the Township, and file cabinets for use by various Township departments, (b) the resurfacing of Mt. Benevolence Road and various other roads in the Township, (c) the upgrade and renovation of Township facilities including the pickle ball storage area, the dais and the meeting room, together with for all the aforeaid all structures, equipment, site work, work, materials, apparatus and appurtenances necessary therefor or incidental thereto, all as shown on and in accordance with the plans and specifications therefor on file or to be filed in the office of the Township Clerk and hereby approved.

It is the opinion of the Township Committee of the Township, as the governing body thereof, that it is in the best interest of the Township that $45,240, constituting proceeds of obligations of the Township heretofore issued under Ordinance Nos. 22-07 ($35,240) and 23-06 ($10,000) of the Township, shall be appropriated to and used to finance costs, including incidental expenses, of the improvement or purpose above described in Section 2 of this ordinance.

The capital budget or temporary capital budget of the Township is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith and the resolutions promulgated by the Local Finance Board showing all detail of the amended capital budget or temporary capital budget and capital program as approved by the Director, Division of Local Government Services, are on file with the Township Clerk and are available for public inspection.

This ordinance shall take effect after publication after final passage as provided by law.

ORDINANCE 2025-09

AN ORDINANCE TO AMEND, REVISE AND SUPPLEMENT CHAPTER 370 OF THE TOWNSHIP CODE, ENTITLED “TRAFFIC”, MOST NOTABLY SECTION 370-9, ENTITLED “VEHICLES OVER DESIGNATED WEIGHT EXCLUDED FROM CERTAIN STREETS”

WHEREAS, the Township of Stillwater continues to address commercial truck traffic using Township roads that can not accommodate such truck traffic, causing unsafe conditions to those members of the traveling public using said roads, along with the homeowners bordering such roads and the utilities located along said roads; and,

WHEREAS, due to various mapping programs, said trucks continue to transverse such roads and when they are giving violations, said violations have not produced the desired result and the Township believes that an increase in road designations and possible penalties can be an additional deterrence to the existing and growing problem.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Stillwater, County of Sussex, State of New Jersey that Chapter 370 of the Township Code, entitled “Traffic”, most notably Section 370-9, entitled “Vehicles over designated weight excluded from certain streets” be amended, revised and supplemented as follows:

A. Vehicles over the registered gross weight are hereby excluded from the streets or parts of streets described, except for the pickup and delivery of materials on such streets.

B. Violations and penalties. Unless another penalty is expressly provided by New Jersey Statute, any person convicted of a violation of this section shall be punished for a first (1st ) conviction thereof by a fine of One Thousand ($1,000.00) Dollars; for a second (2nd ) such conviction, such person shall be punished by a fine of One Thousand Five Hundred ($1,500.00) Dollars; and, upon the third (3rd) or any subsequent conviction, such person shall be punished by a fine of Two Thousand ($2,000.00) Dollars. The owner of a vehicle in violation of this section will be jointly liable for the penalties imposed.

NOW, THEREFORE, BE IT FURTHER ORDAINED that:

(1) All other provisions of Section 370-9 of the Township Code and all other provisions of Chapter 370 of the Township Code not amended, revised and/or supplemented above shall remain in full force and effect.

(2) If any article, section, subsection, sentence, clause and/or phrase of this Ordinance is found by a court of competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance and they shall remain in full force and effect.

(3) All existing Township Code provisions/ordinances or parts of existing Township Code provisions/ordinances which are inconsistent with the terms of this Ordinance, are to the extent of such inconsistency(ies) only, repealed.

(4) This Ordinance shall take effect immediately upon final passage, approval and publication in accordance with law.

NEW BUSINESS:

ORDINANCE INTRODUCTION AND FIRST READING- Public Hearing & Final Adoption May 6, 2025

ORDINANCE 2025-10

CAPITAL ORDINANCE APPROPRIATING $5,284.60

FOR THE LINING OF PARKING LOTS OF STILLWATER

AREA PARKS PAVED IN 2024

BE IT ORDAINED by the Township Committee of the Township of Stillwater, in the County of Sussex, New Jersey, AS FOLLOWS;

Section 1. The improvements described in Section 3 of this capital ordinance are hereby respectively authorized as general improvements to be made or acquired by the Township of Stillwater, New Jersey. For the said improvements or purposes stated in said Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriations made for said improvements or purposes, said sums being inclusive of all appropriations heretofore made therefore and amounting in the aggregate to $5,284.60, which has heretofore been set aside for the improvement of purpose stated in Section 3 and now available therefore by virtue of provision in a previously adopted budget or budgets of the Township for capital improvement purposes.

Section 2. For the financing of said improvements or purposes and to meet the part of said $5,284.60 appropriations, the Township will use funding as described in Section 3.

Section 3. The improvements hereby authorized and the purpose for the allocation of which said obligations are to be spent, the appropriation made for an estimated cost of such purpose, and the estimated maximum amount of funds to be spent for such purpose, are respectively as follows:

Lining Costs of Paved Parking Lots: $566.14 Ord 2019-04: Playground-Phase 2

$118.39 Ord 2022-08: Pond Brook Paving

$1,697.83 Ord 2018-06: Stillwater Park Improv.

The aforestated improvements or purposes where applicable, are in accordance with specifications on file in the office of the Township Clerk, which specifications are hereby approved.

Section 4. The following additional matters are hereby determined, declared, recited and stated:

  1. The said purposes described in Section 3 of this capital ordinance are capital expenses and are each a property or improvement which the Township may lawfully acquire or make as a general improvement, and no part of the cost thereof has been or shall be specifically assessed on property specially benefited thereby.
  2. The average period of usefulness of said purposes within the limitations of said Local bond Law and taking into consideration the respective amounts of the said obligations authorized for the several purposes, according to the reasonable life thereof computed by this capital ordinance, is twenty (20) years.

Section 5. This capital ordinance shall take effect ten (10) days after the first publication thereof after final adoption, as provided by said Local Bond Law.

RESOLUTION 2025-073

RESOLUTION AUTHORIZING ACCEPTANCE OF

2022 RECYCLING TONNAGE GRANT

WHEREAS, the Township of Stillwater has been awarded a 2022 Recycling Tonnage Grant from the New Jersey Environmental Protection Agency; and

WHEREAS, the total amount of the Grant Award is $2,227.09; and

WHEREAS, the Township of Stillwater accepts the award of the 2022 Recycling Tonnage Grant in the amount of $2,227.09;

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Stillwater, New Jersey as follows:

  1. The Township of Stillwater hereby accepts the 2022 Recycling Tonnage detailed above.
  2. The Chief Financial Officer is authorized to establish a grant line in the amount of $2,227.09.

RESOLUTION 2025-074

RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF STILLWATER AUTHORIZING THE TOWNSHIP TO PARTICIPATE IN THE UNION COUNTY COOPERATIVE PRICING AGREEMENT

WHEREAS, N.J.S.A. 40A:11-1 et. Seq. authorizes contracting units to enter into Cooperative Pricing Agreements; and

WHEREAS, the County of Union hereinafter referred to as “the Lead Agency” has offered voluntary participation in a renewal participation in a Cooperative Pricing System for the purchase of work, materials and supplies; and

WHEREAS, the Township of Stillwater in the County of Sussex desires to participate in the Union County Cooperative Pricing Agreement.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Stillwater, in the County of Sussex, State of New Jersey that the Township Council authorizes the Township of Stillwater to participate in the Union County Cooperative Pricing Agreement and execute a Cooperative Pricing Agreement with the County of Union upon its approval by the Division of Local Government Services; and

BE IT FURTHER RESOLVED, that the County of Union as Lead Agency is expected to comply with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et. Seq. and all of the provisions of the revised statutes of the State of New Jersey).

RESOLUTION 2025-075

A RESOLUTION TO APPROVE THE STILLWATER TOWNSHIP BICENTENNIAL PARADE

WHEREAS, the Township of Stillwater will be hosting their Bicentennial Celebration; and

WHEREAS, in celebration of the Bicentennial, the Township of Stillwater will host the Bicentennial Parade in the Township of Stillwater on June 7, 2025, commencing at 1:00 P.M.; and

WHEREAS, the parade route will be as follows:

  1. Fredon Road, County Route 610 (lineup)
  2. Up Route 610 to Main Street to County Route 521 to Pond Brook Road, County Route 619
  3. Ends in Veteran’s Park parking lot; and

WHEREAS, the parade will take approximately two hours during which no parking will

be permitted on the parade route; and

WHEREAS, the Township of Stillwater will be notifying the residents of the Parade in a timely manner so that they will be duly informed; and

 

WHEREAS, Stillwater Township Department of Public Works has agreed to the removal of all trash after the celebration.

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Stillwater to grant approval for the Stillwater Township Bicentennial Parade on June 7, 2025, in Stillwater Township as stated above.

RESOLUTION 2025-077

AUTHORIZING THE ISSUANCE OF ANNUAL CAMPGROUND LICENSE

WHEREAS, the Township Committee of the Township of Stillwater, County of Sussex and State of New Jersey, pursuant to the authority vested in it by an act of Legislature, has heretofore by ordinance, provided for campgrounds in the Township of Stillwater; and

WHEREAS, the following named Campground holder has filed an application for the license renewal, passed inspections and all fees have been paid.

NOW, THEREFORE, BE IT RESOLVED, that the following campground license be granted renewal for the period of May 1, 2025 to April 30, 2026.

BE IT FURTHER RESOLVED, that the Township Clerk is hereby authorized to issue the License herein granted, the same effective as provided by Law.

APPROVAL OF THE CONSENT AGENDA

Mayor L. Chammings noted that she had one correction to make to the April 1, 2025, meeting minutes on page two regarding who had identified a couple of inconsistent areas. She will speak with V. Ingles about what it should state.

DISCUSSION ITEMS:

  1. Buzzer for Meeting Room Door

Mayor L. Chammings stated this was a request from the staff to have a buzzer installed for the meeting room door so that a key would not need to be handed back and forth every time someone wants to use the restroom. She stated that the committee can speak with the staff directly for more information before spending $1,300 on the buzzer.

  1. HVAC Quotes for Municipal Office Meeting Room

The Township Committee discussed the three quotes received for the HVAC in the municipal office meeting room. Willco came in with the lowest bid, and the township decided to use them, subject to the availability of funds. They asked the Municipal Clerk to contact Poust to notify them that the township will not be using them.

A MOTION was made by Deputy Mayor V. Rumsey and seconded by Committeeman G. Scott, to approve using Willco- Option #1 for the HVAC in the municipal office meeting room, subject to the availability of funds and necessary paperwork.

  1. Ambulance- Steven Sugar

S. Sugar stated that the trailer is back at the firehouse. It was driven from D&E as it was running. Mayor L. Chammings stated that they would like the ambulance brought to the DPW garage for the township mechanic to look over. The mechanic will also complete a pressure test. The township still currently owns the ambulance and will pay the $225 tow bill from when the ambulance was taken to D&E, and go from there.

  1. Community Center Door

Deputy Mayor V. Rumsey stated that they are looking to replace the community center door. There have been numerous issues with the door, so they are going to have the DPW remove it and sell it on Municibid. Physical keys will be given out again to the groups meeting there and to the private parties.

  1. Community Center Fees & Application

The discussion on the community center fees will be carried on the advice of counsel.

Township Resident L. Sylvester thanked the township committee for all that they do. He also thanked V. Ingles and D. Tighe for all their help with information and getting the word out for the Memorial Day service. The 21st annual Memorial Day Service at Veterans Park is coming up, and everyone is invited to attend. Deputy Mayor V. Rumsey thanked Mr. Sylvester for everything that he does as well, and that it’s always a beautiful service. Mr. Sylvester also thanked the DPW for all their work at the park; everything looks fantastic. Mayor L. Chammings also noted that the DPW has done an incredible job cutting back the invasives and making the park beautiful. Committeeman D. Manser stated that they also did a great job behind the playground. He noticed lots of people fishing there over the weekend, which is great. Mr. Sylvester stated that the last piece of the puzzle is making the park more handicap accessible. He stated that there are grants out there to make it ADA-compliant.

RESOLUTION 2025-076 AUTHORIZING PAYMENT OF BILLS

WHEREAS, the Chief Financial Officer has certified that funds are available in the proper account; and

WHEREAS, the Chief Financial Officer has approved payment upon certification from

the Township Department Heads that the goods and/or services have been rendered to the

Township;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Committee of the Township of Stillwater that the current bill lists, dated April 1, 2025, are on file and available for public inspection in the Office of the Chief Financial Officer and approved by the Chief Financial Officer for payment, be paid.
